Terms of Service Agreement

This Terms of Service Agreement ("Agreement") is entered into by and between Spot Saver LLC ("Company") and the user ("User" or "You") accessing or using The Spot Saver ("Product"). By accessing or using the Product, You agree to be bound by the terms and conditions of this Agreement.

1. Acceptance of Terms

By accessing or using the Product, You agree to be bound by this Agreement and any other policies or guidelines referenced herein, including but not limited to our Privacy Policy. If You do not agree to all of the terms and conditions of this Agreement, You may not access or use the Product.

2. Use of the Product

(a) You agree to use the Product only for lawful purposes and in accordance with this Agreement and all applicable state and federal laws and regulations.

(b) The Spot Saver must be properly stored prior to operating a vehicle on the roadway. Spot Saver LLC shall not be held liable for any accidents, damages, or injuries resulting from failure to properly store The Spot Saver before driving. It is the responsibility of the user to ensure that The Spot Saver is securely stored in a safe location that does not impede the safe operation of the vehicle. Spot Saver LLC disclaims any liability for misuse, improper storage, or negligence in handling The Spot Saver.

(c) It is critical that all Spot Saver products be properly and securely attached to your vehicle. Improper attachment could result in an automobile accident and could cause serious bodily injury or death to you or others. You are responsible for securing the device to your car, checking the attachments prior to use, and periodically inspecting the products for adjustment

(d) Do not climb, sit, or stand on or allow children to climb, sit or stand on the assembled product

3. Intellectual Property

(a) The Product and its original content, features, and functionality are owned by Spot Saver LLC and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

(b) You may not modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Product, except as provided herein or with the prior written consent of Spot Saver LLC.

4. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Spot Saver LLC, its affiliates, or their respective officers, directors, employees, or agents be liable to You or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages arising out of or in connection with the use of or inability to use the Product.

5. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Minnesota, without regard to its conflict of law provisions.

6. Changes to Terms

Spot Saver LLC reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, Spot Saver LLC will provide at least 5 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Spot Saver LLC's sole discretion.
